*******************************************************************************************************************

O juiz Murilo Mendes negou o pedido.

Veteranos do Iraque e do Afeganistão processam EUA

As críticas

PROTEST

I protest against the image of Carmem Miranda and the phrase "My business is bananas" (posted in Joe Sharkey's blog only two days after the tragic accident with TAM airplane in Sao Paulo. That's, to say the least, bad taste from the part of Joe Sharkey. In a moment of so much distress, this kind of irony is unacceptable, specially coming from professional journalists.

FROM http://goltragedy.blogspot.com/

http://goltragedy.blogspot.com/

The undisputed facts indicate that:
1) the Legacy was flying at an unauthorized altitude of 37,000 feet, rather than the flight-plan mandated 36,000 feet;
2) The GOL flight was flying the opposite direction as the Legacy, at its CORRECT altitude of 37,000 feet;
3) The winglet and horizontal stabilizer of the Legacy struct the GOL Boeing, sending it into an uncontrolable dive.
4) 154 people abord the GOL flight died as a direct result of the crash.
5) The transponder on the legacy was turned ON at the time of its take off.
6) The transponder on the legacy was tuned OFF at the time of the impact; and
7) The transponder on the legacy was tuned ON shortly after the impact and at the time of landing.

The disputed fact is whether or not the Legacy pilots turned off their transponder, which would preclude the collision warning system on both planes to alert the pilots of an impending collision in time to alter course. Regardless of whether the pilots purposefully turned the transponder off, it is unquestionable and undeniable that they were reckless in flying at an incorrect altitude that they knew or should have known was reserved for air traffic flying in the opposite direction.

Nonetheless, I find it impossible that the transponder in a BRAND NEW jet was working improperly. This is not a FIAT! This is a multimillion dollar jet built to strict safety specifications mandated by the FAA, Brazilian authorities and other government agencies. The transponder is a safety feature that surely underwent thorough inspection prior to takeoff. Nonetheless, the Legacy pilots and NY Times Journalist Joe Sharkey maintain that the transponder malfunctioned for the brief amount of time required to blow a Boeing jet out of the sky!

This horrible tragedy is being spun in the american media by journalists like Joe Sharkey who wish to paint a picture of a Brazilian government bound on point the finger at innocent "hero[es]" who saved Mr. Sharkey's life.

I will use this blog to post updated information in English language from Brazilian sources.

Brazilians have always been good friends of the United States. We welcome all americans and other foreigners with open arms. However, we are a sovereign, democratic nation comprised of laws. We will investigate this disaster and will charge the Legacy pilots with 154 counts of manslaughter for their reckless acts above the skies of our contry. The same thing would be done if this had occurred over the skies of the United States. For example, the US court system sent two pilots to jail in June of 2005 for being drunk on the cockpit of an America West aircraft (see http://www.usatoday.com/travel/news/2005-06-08-drunk-pilots_x.htm). These pilots did not even take off, yet their reckless disregard for human life landed them in prison. The Legacy/GOL tragedy is a case of pilot recklessness that caused the death of 154 innocent persons. These pilots will face the consequence of their actions.

REALITY

An excerpt from a message - maybe posted, maybe censored- in another blog.

One thing is an OPINION. The other is reality and the facts that configure such reality.

"...one more OBVIOUS thing (and I hope I won't be censored at this time, but anyways...): nowadays, ANY international matter related to anything (security, economy, politics, health, etc) MUST have the participation of European countries. As a Brazilian, I WELCOME any criticism (as strong as it may be) from the European Nations. Unfortunately, the same cannot be said about the Americans. This attitude is not a personal opinion, it is actually based on FACTS. I live in the US, I work in the US, I am housing an American in my apartment for free, I have many American friends, I am not against Americans. I am just pointing out FACTS. Facts that cleary show that, due to recent international events, Americans have little or NO authority over important matters around the planet. Any Federal organism in the US is questionable. And this is not ANTI-americanism. This is not hostility. Can't you separate things???This is based on facts (and lies told to millions of people worldwide by the actual American administration)".

BEING JOE SHARKEY

When a journalist uses a blog to censor messages that disagree with what he/she wrote, then this person cannot be taken seriously. Unfortunately, Joe Sharkey manipulates the way he filters messages in his blog. First he claims he has received 'death threats' from Brazilian bloggers. These are teenagers who can barely write in english and who probably had no clue as why or what they were attacking in that blog. A big midia corporation in Brazil linked its website to Joe Sharkey's limbo-blog for a few hours in the aftermath of the disaster in Congonhas airport. Obviously messages of all kinds were sent to him. But Joe Sharkey goes even further and states that these messages are representative of the people who are investigating the collision between Gol and Legacy last year. Nothing could be further from the truth. Nothing could a bigger distortion of reality. Nothing could be a bigger lie. Go to any blog, go to youtube...it's plenty of messages full of hate. I believe those people represent THEMSELVES, not anybody else. But Joe Sharker, perhaps ignoring the reality of his own government, states that it's the Brazilian government that is constantly influenced by 'emotion'. George Bush 'Mission Accomplished' fallacy broadcasted nationwide to boost the moral of millions of his supporters and pro-war morons is probably...nothing...just nothing...The American government policies based on FEAR are nothing...just nothing...

LESSONS NOT LEARNED (taken from the New York Times)

By JACQUELINE PALANK
Published: July 20, 2007
WASHINGTON, July 19 — The chairman of the House oversight committee on Thursday accused the Federal Emergency Management Agency of refusing to acknowledge high levels of formaldehyde in trailers it provided to hurricane evacuees on the Gulf Coast.

In testimony on Thursday, three people who had lived in the trailers said they believed that exposure to formaldehyde, which is found in many building materials, was the cause of health problems including sore throats, burning eyes and respiratory problems .

The administrator of FEMA, R. David Paulison, told the subcommittee he was not “100 percent sure that it was the trailers” that caused residents’ health problems. But Mr. Paulison also said that, in hindsight, the agency could have moved faster when problems were reported in some of the more than 120,000 mobile homes and travel trailers provided to evacuees.

“We were not formaldehyde experts,” he said. “We recognize now that we have an issue. We are dealing with it in the best manner we can.”

The chairman of the oversight committee, Representative Henry A. Waxman, Democrat of California, said 5,000 pages of documents released Thursday revealed a battle between the FEMA field staff and officials at the agency’s headquarters.

“They wanted to ignore the problem,” Mr. Waxman said, referring to headquarters officials. “What we have is indifference to the suffering of people who are already suffering because of Hurricane Katrina, and this is from an agency that’s supposed to serve the public.”

Mr. Waxman said that after news reports in March 2006 about formaldehyde in the trailers, members of the field staff urged immediate action. He quoted a response in an e-mail message from a FEMA lawyer who said: “Do not initiate any testing until we give the O.K. Once you get results, the clock is running on our duty to respond to them.”

The documents include an e-mail exchange among agency staff members dated June 27, 2006, relating the news that one person had been found dead in a trailer in St. Tammany Parish, La.

Referring to the use of air-conditioning, one e-mail message said: “We do not have autopsy results yet, but he had apparently told his neighbor in the past that he was afraid to use his A.C. because he thought it would make the formaldehyde worse.”

The staff member who wrote it recommended further investigation and said that the agency’s office of general counsel had told a different employee that it “has not wanted FEMA to test to determine if formaldehyde levels are in fact unsafe.”

Mary DeVany, an industrial hygienist with her own practice, testified that it is not rare to find formaldehyde in homes, because it is used in pressed wood products like particleboard and plywood, and in glues and certain insulation materials. Ms. DeVany said several agencies, including the Environmental Protection Agency, had classified the chemical as a probable or known human carcinogen.

Paul Stewart of Bay St. Louis, Miss., who lived in a FEMA travel trailer from December 2005 to March 2006, said the agency was unresponsive to calls about his suspicion that the trailer was making him ill, so he ordered a test kit and determined that formaldehyde levels were high.

When Mr. Stewart reported the results to the agency and asked for a new trailer, he said, “The way FEMA treated us was as if we were charity cases.” He added, “To them, it was like you were asking for something better.”

Lindsay Huckabee of Kiln, Miss., said that after moving into a FEMA mobile home in December 2005, she, her husband and four children began to experience symptoms that she now believes were related to formaldehyde exposure. Visits to doctors became a common occurrence. Ms. Huckabee, who was pregnant when she moved in, said she experienced preterm labor for three weeks that had to be stopped with medication. Even then, her son was born four weeks early.

Mr. Paulison said the agency received its first complaint of formaldehyde fumes in March 2006, six months after the trailers were first delivered. He said that “after a prompt review,” officials replaced the trailer listed in the complaint on March 19. He said 58 of the 66,800 travel trailer and mobile homes now in use had been replaced because of formaldehyde concerns and that as a result of five other complaints, residents were moved to rental housing.

On the eve of the hearing, the agency announced it that it had asked the Centers for Disease Control and Prevention to test air quality in occupied trailers. The study will begin next week.

Mr. Paulison said FEMA had updated its trailer purchase specifications, improved training of the agency and medical staff members who must respond to complaints and increased efforts to move residents into other long-term housing.

Representative Mark Souder, Republican of Indiana, which is home to many mobile home manufacturers, expressed concern that the hearing was portraying the industry unfairly.

“What we have are terrible personal stories,” Mr. Souder said. “To just uniformly, without research, make the assertions that I’ve been hearing today about an industry is irresponsible.”

LESSONS NOT LEARNED

IS JOE SHARKEY A RACIST?? 'just' EVIL??

Why a journalist has to post the image of Carmem Miranda with the letters "banana is my business" to comment on the discussion of the accident with TAM that took place two days ago??? I wonder what would be the reaction of Americans if we use the picture of an american soldier killing an innocent Iraq child to illustrate a discussion about what the US is up to around the globe. Or maybe an airplane spreading orange gas to decimate entire populations in Vietnam. Or maybe the picture of an American official shaking hands with Osama Bin Laden when the terrorist was working for the American killers. Or so many other atrocities and coward acts that come from the US. Why does this journalist have to attack Brazil in its essence instead of debate the problem? Possible answers: 1- the guy is a racist; 2- the guy is evil 3- the guy found a way to make money; 4- all of the above.

I believe my last comment was censored by Joe Sharkey. It reveals his democratic principles. Perhaps he is part of the millions of cowards who voted for a mass murderer, maybe he doesn't like when we point out some facts that go beyond what HE believes it's true.

BY THE WAY: I was navigating through YOUTUBE today and saw some death threats from people. Shall we call those who wrote such nasty things terrorists?? Maybe Joe Sharkey would.

DAVID

Without asking for his permission because I don't have his contact and he doesn't seem to have a blog, I am copying and pasting David's message from Joe Sharkey's blog. I will erase it if the author tells me to do so.
I just think David is absolutely right. Thanks David. I really appreciated what you wrote.

"David said...
A correction: USA is, famously, a thin-skinnd country where politics are inexorably tied to public emotion [we need security, then let's invade Iraq], and where political skill is usually a matter of being able to manipulate that emotion [Bush knew how to make you believe that Saddam was hiding non-existing mass destruction weapons]. The United States media are, famously, an integral part of that process.

Brazil has many problems and the people are upset about them. Most Brazilians want Mr. Pires away from his job and the oposition support grows stronger.

Aviation is in crisis and one of the opposition deputies working on Air Traffic Investigations against Mr. Pires, Julio Redecker (PSDB-RS), was killed on that accident. But since October you seem to have dedicated your life to write against Brazil, and when you say that Whac-a-Mole should replace Football as the national sport you are offending the entire country, not only those responsible for Air Traffic Chaos. Please limit your comments.

The country [especially the Rio Grande do Sul and São Paulo State, from which most victims are] is in shock.

Last, but not least, if you are concerned about the "heroes" who are suspect to have turned off the plane's transponder or about yourself, nevermind. USA has no extradition agreement with Brazil regarding its citizens.

Then, if you don't want to help those who suffer from TAM and GOL tragedies, simply forget about Brazil."

JOE SHARKEY and "how to distort" the facts

My GOSH, the beginning of this 'EDITORIAL" is outrageous (check, unfortunately, Joe Sharkey's editorial first making fun of Brazil, then saying that he received direct death threats from Brazilian bloggers!!).

Most of the messages come from angry youngsters who can barely write in English. And OBVIOUSLY nobody there will kill anyone!! "DIRECT DEATH THREATS"??? are you joking or what? You cannot be serious when you state that some of the 170-plus comments have any relationship to the facts related to the accident with Gol and Legacy and how the investigation has been conducted. In what planet do you live? Bushland?? By the way: has it been proved that the Legacy pilots were NOT 'showing off' the aircraft capabilities? Has it been proved that they were not completely illegaly violating safety standards? What about the TCAS?? Has it been proved that it was NOT turned off?? HAS IT BEEN PROVED??? DAVID'S POST says it all!!! Keep writing against Brazil. Keep distoring the facts. The link to your silly blog lasted a few hours. Now you go back to limbo again. Meanwhile, believe or not, Brazilian society is debating this crisis and I am not exception. DO YOU KNOW WHAT caused the accident with TAM two days ago? So, do not make any comments about it. Try to be minimaly professional.

And YES, THE IMAGE OF CARMEM MIRANDA represents Brazil in the US, specially for old people like you. But hey, that's not bad. We are not the ones who spread out hate and blood around the globe. The image of A COWARD like your president and the millions of COWARDS who voted for him, those are the images that represent the United States of America today. And we know very well that that's not MY opinion.

Last but not least: this person called BO. Dude, I am so sorry about your child. I am very sorry for him. It must be very frustrated to have a father like you around. By the way: the chances that your child will be able to attend school without getting killed by one of his colleagues is much better in the 'type of environment' where he lives. The chance he will become someone more aware of the planet and the problems around us is much bigger too! But of course those are irrelevant things for you. And how things are going, the chances he can have better health system is greater too. And I am pretty much sure his country mates will never vote for a mass murderer TWICE. FINALLY, I am totally sure he will become a much better person than you are. That seems obvious based on what you just said.

Joe Sharkey on TV

Mr. Sharkey, you are absolutely right about the enormous mess in pretty much all the brazilian airports these days. The brazilian government has been incompetent and irresponsible with this matter.
Now, I am sorry for going back to that horrible accident between Gol and Legacy aircrafts. Something else happened on the day you survived that accident. I know there is a lot of controversy involved, but you try to protect those two pilots like your president tries to protect the 'heroes' who are right now killing hundreds of innocent people in Iraq. Let the facts speak. The two pilots WILL NOT go to jail if they are innocent. It's true that they were held in Brazil for many days, but I wonder what would have happened if the accident had happened in the States and those pilots were from another country. But there is something else that I would like to point out, if I may: I still remember seeing you giving a happy interview to ABC or CBS or another one of these ultra-crappy TV networks in the US IMMEDIATELY after that tragedy that killed over a hundred people. Tell us, we need to know, how much did they pay you to do that? Obviously these networks couldn't care LESS about human beings, but still, you could have said "NO, not now". It sounded like the whole thing was just another adventure film. It sounded like it was just bad luck that those people got killed, but thanks to the good God things were fine and the show had to continue. Unfortunately, I saw your interview and it made me want to throw up. Life is a continuous learning curve. I wish you well, but I would like you to admit that your interview was totally inappropriate and insensitive.
Regards, Carlos
